These Terms of Service ("Terms" or "Agreement"), together with our Privacy Policy, govern your access to and use of the website and services provided by Flash Discount Club ("Company," "we," "our," or "us"). By accessing or using our website or purchasing from us, you agree to these Terms. If you do not agree, you must not use our services.
1. FLASH DISCOUNT CLUB MEMBERSHIP AND SUBSCRIPTION TERMS
We offer a membership program that grants access to exclusive product discounts, limited-time offers, and promotional perks. This subscription is available for $29.99 USD per month (plus applicable taxes).
Enrollment and Charges: When you purchase a product bundle through our website, you may be enrolled in a 30-day membership subscription, which automatically renews each month unless canceled. You must provide a valid payment method at checkout, and your card will be charged $29.99 every 30 days unless you cancel in accordance with these Terms.
Automatic Renewals: Your subscription will automatically renew every 30 days, and you will be charged $29.99 (plus taxes, where applicable) until canceled.
Cancellation: You may cancel at any time by visiting our Cancellation Form, emailing us at support@flashdiscountclub.com, or calling (844) 503-5274. Cancellations must be received at least 3 business days prior to the next billing date to avoid being charged for the upcoming period.
Refunds: ALL SALES ARE FINAL. No refunds will be issued for product purchases or membership fees unless otherwise stated at checkout or required by law.
Payment Authorization: By submitting your payment method, you represent you are authorized to use it and consent to automatic charges for recurring membership fees. You agree to update your payment details promptly if they change. We reserve the right to correct billing errors at any time.
Shipping, Product Sourcing, and Quality Disclaimers: Flash Discount Club sources many of its products from third-party suppliers, including international vendors such as those based in China. Shipping times may vary and can take several weeks for delivery. While we strive to provide accurate product descriptions and images, minor variations in product appearance, packaging, or quality may occur. We are not responsible for customs delays, additional duties or taxes, or dissatisfaction resulting from product quality where the items meet standard specifications.
2. DISPUTE RESOLUTION
Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
Arbitration Agreement: Any disputes arising out of or related to these Terms or our services shall be resolved exclusively through final and binding arbitration, not in court. This includes disputes with our affiliates, contractors, agents, officers, and employees. Arbitration will be conducted by JAMS or another mutually agreed-upon arbitration provider in accordance with its streamlined rules.
Class Action Waiver: You may only bring claims in your individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Venue: Unless otherwise agreed, the arbitration will take place virtually or in Miami, Florida. Each party is responsible for its own attorneys' fees unless otherwise provided by law.
3. DISCLAIMERS & LIMITATION OF LIABILITY
As-Is Services: All products and services are provided "as is" without warranties of any kind. We disclaim all express or implied warranties, including but not limited to merchantability or fitness for a particular purpose.
Limitation of Liability: To the fullest extent permitted by law, our total liability for any claims related to your use of the service shall not exceed $100 or the amount paid by you in the past 12 months, whichever is greater. We are not liable for indirect, incidental, or consequential damages, including lost profits or data.
4. RISK AND INDEMNIFICATION
You use our services at your own risk. You agree to indemnify and hold harmless Flash Discount Club and its affiliates, officers, directors, and employees from any claims or damages arising out of your use of our services, including violations of these Terms or applicable laws.
5. CHANGES TO TERMS
We may update these Terms at any time. Changes will be posted on our website with a new effective date. Your continued use of the services constitutes your agreement to the updated Terms.
6. ACCOUNT USE AND RESPONSIBILITIES
You must be at least 18 years old to use our services. You are responsible for maintaining the confidentiality of your account and payment information. You agree not to misuse the website, reverse engineer our systems, or violate any laws in your use of our services.
7. THIRD-PARTY CONTENT
We may link to or reference third-party websites or services. We do not endorse or guarantee the accuracy or reliability of such content and are not responsible for your use of any third-party sites.
